El objetivo del presente trabajo es doble. En primer lugar, pretendo defender un concepto simpliciter de tolerancia según el cual la autonomía personal o la necesidad de fortalecer una cultura son las únicas razones que debe ponderar el agente-Estado para tolerar. En segundo lugar, pretendo responder afirmativamente a la pregunta de si puede el liberalismo perfeccionista y multicultural de Joseph Raz sostener desde la teoría moral y política un derecho intercultural. Para cumplir estos objetivos, me concentraré en los usos morales (...) del término tolerar para luego siguiendo a Michael Sandel, analizar los casos de tolerancia crítica y no crítica. Posteriormente, desarrollaré el liberalismo de Raz con el fin de mostrar los problemas teóricos que genera el fundamento de los derechos colectivos. Concluiré afirmando la existencia de derechos colectivos como recurso institucional para permitir el desarrollo de grupos culturales minoritarios dentro del actual desarrollo del Estado- nación. In general, the development of the theory of the legal system has focused on the contributions of legal positivism authors, leaving to one side the contributions of natural law theory. This study seeks to rebuild the theory of the legal system developed by the School of Salamanca’s founder, Francisco de Vitoria, showing its explanatory advantages in comparison with the first analytical legal theory of legal system formulated by John Austin. This study shows that, just as in Austin, it is possible (...) in Francisco de Vitoria to reconstruct the existence and identity criteria of legal systems from the notions of command and sovereignty. These findings allow us to maintain that 300 years before Austin, and in a non-analytical environment, Francisco de Vitoria developed a theory of legal system. (shrink)

Este trabajo pretende examinar las relaciones entre derecho, ideología y discurso. Para ello se asume la teoría sociocognitiva de la ideología de Teun van Dijk y el enfoque institucional acerca de la naturaleza del derecho de Joseph Raz explorando la posibilidad de la existencia de ideologías legales. A partir de un ejemplo, se muestra la imbricación del campo político con el campo de la justicia y se concluye que los jueces adhieren al menos a dos grupos ideológicos, uno de carácter (...) político y otro de carácter profesional. This paper aims to examine the relationship between law, ideology and discourse. To do this, the sociocognitive theory of Teun van Dijk’s ideology is ascribed together with Joseph Raz’s institutional approach to the nature of law by exploring the possibility of existence of legal ideologies. Starting from an example, we show the overlap between the political field with the field of justice and conclude that judges adhere to at least two ideological groups, one of a political nature and the other of a professional nature. Desde la mirada de los estudios de la cultura y la hegemonía del poder esta investigación explora desde la perspectiva de sus habitantes, el sentir popular y la apropiación de la celebración religiosa de San Pedro y San Pablo en la parroquia Picoazá (Portoviejo – Ecuador). Para el fin se acude a la metodología cualitativa, utilizando la entrevista como herramienta de corte etnográfico. Los resultados plantean un colectivo apegado a la religión con connotaciones significativas en la organización social y (...) cultural del entorno, dando paso a la reproducción de tradiciones heredadas de generación en generación. Las mismas que a la par, fetichizan y esencializan la actividad, e invisibilizan otros aspectos inherentes a las prácticas culturales. (shrink)

«Claros del bosque» es uno de los libros esenciales de la trayectoria filosófica de María Zambrano en el que vemos, por primera vez, en marcha su «razón poética». Nadie mejor que la propia autora para presentarnos el significado de esta obra: “«Claros del bosque» dentro de mi pensamiento vertido en lo impreso, salvo alguna excepción, aparece como algo inédito salido de ese escribir irreprimible que brota por sí mismo y que ha ido a parar a cuadernos y hojas que (...) nadie conoce, ni yo misma, reacia que soy a releerme. Tenía que suceder por fuerza. Mas creo que el carácter de ofrenda de «Claros del bosque» a la persona a quien va dedicado en su tránsito tiene que ver en ello, acentuando así el carácter de ofrenda que todo lo que he publicado tiene desde siempre. Nada es de extrañar que la razón discursiva apenas aparezca. Con anterioridad esbocé una ‘Crítica de la razón discursiva’ que no podría prometerme que salga de ese estado. Creo, pues, que como libro es el que más responde a esa ‘idea’ hace tiempo formulada de que ‘pensar es ante todo –como raíz, como acto–– descifrar lo que se siente’, entendiendo por sentir el ‘sentir originario’, expresión usada por mí desde hace años. Y también que ‘el hombre es el ser que padece su propia trascendencia’ en un incesante proceso de unificación entre pasividad y conocimiento, entre ser y vida. We say that a sentence A is a permissive consequence of a set X of premises whenever, if all the premises of X hold up to some standard, then A holds to some weaker standard. In this paper, we focus on a three-valued version of this notion, which we call strict-to-tolerant consequence, and discuss its fruitfulness toward a unified treatment of the paradoxes of vagueness and self-referential truth. For vagueness, st-consequence supports the principle of tolerance; for truth, it supports the (...) requisite of transparency. Permissive consequence is non-transitive, however, but this feature is argued to be an essential component to the understanding of paradoxical reasoning in cases involving vagueness or self-reference. How can expressivists make sense of the practice of communication? If communication is not a joint enterprise aimed at sharing information about the world, why do we engage in communication the way we do? Call this *the problem of communication*. Starting from basic assumptions about the rationality of speakers and the nature of assertion, we argue that speakers engaging in conversation about normative matters must presuppose that there is a unique normative standard on which the attitudes of conversational participants ought (...) to converge. This gives the beginning of a solution to the problem of communication on behalf of expressivists. (shrink)

This text proposes an interpretation of the work of Franklin Leopoldo e Silva based on the reading of some of his numerous published articles and books, without neglecting the classes and guidance received from the stage of Scientific Initiation to Postdoctoral studies. Precisely, by highlighting the importance of three thinkers widely studied by Professor Franklin – Berkeley, Bergson and William James –, we suggest that at the heart of this philosophical experience there would be a constant: empiricism. It is widely acknowledged that metaethical expressivism requires taking on some substantive commitments in the theory of meaning. Those commitments, however, do not require abandoning orthodox views in compositional semantics. Instead, they should be understood as bearing on one aspect of the metasemantic project, viz. that of interpreting a compositional semantic theory---what I call 'semantic hermeneutics'. I spell out the nature of this project and distinguish it from that of explaining why words have the meanings that they do. I conclude (...) by outlining a hermeneutics for orthodox compositional semantics that does justice to the expressivist's distinctive views in the philosophy of mind. (shrink)

El «mundo entero» vive un gran desasosiego al estar inmiscuido en la dominación de la Naturaleza sustentada en la gran inversión económica, desde el paradigma antropocéntrico neoliberal. El objetivo del presente trabajo es reconocer y abrazar epistemologías y metodologías alternativas, entre ellas validar las contribuciones de los pueblos indígenas (PI) como protagonistas de la sustentabilidad y soberanía alimentaria. La investigación es de corte documental y la reflexión personal de más de 20 años de labor junto a los PI en Mesoamérica (...) y los Andes. Valorar dichas contribuciones, es centrarse en sus acervos y corpus cognoscitivos, antes que sea tarde. Son los sabios guardianes de la sustentabilidad biocultural de la Naturaleza y la Vida. Se concluye principalmente que son quienes conocen las claves, llaves y secretos que dan respuesta al reto de estelarizar la sustentabilidad y seguridad alimentaria global, que tanto persigue la humanidad. La sociedad en general y en particular las instancias oficiales, formativas, políticas, corporativas, industriales, de extensión y académicas, deben distinguir a estos actores sociales que soportan hoy la seguridad alimentaria mundial. El hallazgo principal cual severa advertencia, es que al «desaparecer» estaríamos ante un fenómeno descomunal de inseguridad alimentaria mundial. (shrink)

I develop a non-representationalist account of mathematical thought, on which the point of mathematical theorizing is to provide us with the conceptual capacity to structure and articulate information about the physical world in an epistemically useful way. On my view, accepting a mathematical theory is not a matter of having a belief about some subject matter; it is rather a matter of structuring logical space, in a sense to be made precise. This provides an elegant account of the cognitive utility (...) of mathematics. Further, it makes explicit how the brand of non-representationalism I develop is compatible with there being substantive rationality constraints on our mathematical theorizing. (shrink)

Epistemic Utility Theory is often identified with the project of *axiology-first epistemology*—the project of vindicating norms of epistemic rationality purely in terms of epistemic value. One of the central goals of axiology-first epistemology is to provide a justification of the central norm of Bayesian epistemology, Probabilism. The first part of this paper presents a new challenge to axiology first epistemology: I argue that in order to justify Probabilism in purely axiological terms, proponents of axiology first epistemology need to justify a (...) claim about epistemic value—what I label ‘Downwards Propriety’—much stronger than any they have offered justification. The second part of this paper offers an argument that this challenge cannot be met: that there is no hope for providing a purely axiological justification of Downwards Propriety, at least given widely accepted assumptions about epistemic value. 1. La concepción materialista de la historia.

In this paper I explore a new approach to the ethics of animal experimentation by conceiving of it as a form of rescue. The notion of rescue, I suggest, involves some moral agent performing an action or series of actions, whose end is to prevent or alleviate serious harm to another party, harm that otherwise would have occurred or would have continued to occur, had that moral agent not intervened. Animal experiments that are utilized as a means to alleviate human (...) illnesses mirror the structure of rescue cases and this means that we can and should apply principles of rescue to illuminate the moral status of animal experimentation. To do this I consider various principles of rescue that might justify animal experimentation. I’ll argue that all of these rescue principles are either not independently plausible, or else they fail to imply that animal experimentation is morally justified. This suggests that it is quite difficult to morally justify animal experimentation when conceived as a form of rescue. (shrink)

It seems natural to think of an unwilling addict as having a pattern of preferences that she does not endorse—preferences that, in some sense, she does not ‘identify’ with. Following Frankfurt (1971), Jeffrey (1974) proposed a way of modeling those features of an agent’s preferences by appealing to preferences among preferences.Th„e addict’s preferences are preferences she does not prefer to have. I argue that this modeling suggestion will not do, for it follows from plausible assumptions that a minimally rational agent (...) must prefer those first-order preferences she actually has. I close by considering two different but related ways to think about the initial phenomenon. (shrink)

Epistemic rationality is typically taken to be immodest at least in this sense: a rational epistemic state should always take itself to be doing at least as well, epistemically and by its own light, than any alternative epistemic state. If epistemic states are probability functions and their alternatives are other probability functions defined over the same collection of proposition, we can capture the relevant sense of immodesty by claiming that epistemic utility functions are (strictly) proper. In this paper I examine (...) what happens if we allow for the alternatives to an epistemic state to include probability functions with different domains. I first prove an impossibility result: on minimal assumptions, I show that there is no way of vindicating strong immodesty principles to the effect that any probability function should take itself to be doing at least as well than any alternative probability function, regardless of its domain. I then consider alternative, weaker generalizations of the traditional immodesty principle and prove some characterization results for some classes of epistemic utility functions satisfying each of the relevant principles. Michel Janssen and Harvey Brown have driven a prominent recent debate concerning the direction of an alleged arrow of explanation between Minkowski spacetime and Lorentz invariance of dynamical laws in special relativity. In this article, I critically assess this controversy with the aim of clarifying the explanatory foundations of the theory. First, I show that two assumptions shared by the parties—that the dispute is independent of issues concerning spacetime ontology, and that there is an urgent need for a constructive interpretation (...) of special relativity—are problematic and negatively affect the debate. Second, I argue that the whole discussion relies on a misleading conception of the link between Minkowski spacetime structure and Lorentz invari-ance, a misconception that in turn sheds more shadows than light on our understand-ing of the explanatory nature and power of Einstein’s theory. I state that the arrow connecting Lorentz invariance and Minkowski spacetime is not explanatory and uni-directional, but analytic and bidirectional, and that this analytic arrow grounds the chronogeometric explanations of physical phenomena that special relativity offers. When we speak about different interpretations of quantum mechanics it is suggested that there is one single quantum theory that can be interpreted in different ways. However, after an explicit characterization of what it is to interpret quantum mechanics, the right diagnosis is that we have a case of predictively equivalent rival theories. I extract some lessons regarding the resulting underdetermination of theory choice. Issues about theoretical identity, theoretical and methodological pluralism, and the prospects for a realist stance towards quantum (...) theory can be properly addressed once we recognize that interpretations of quantum mechanics are rival theories. According to a popular narrative, in 1932 von Neumann introduced a theorem that intended to be a proof of the impossibility of hidden variables in quantum mechanics. However, the narrative goes, Bell later spotted a flaw that allegedly shows its irrelevance. Bell’s widely accepted criticism has been challenged by Bub and Dieks: they claim that the proof shows that viable hidden variables theories cannot be theories in Hilbert space. Bub’s and Dieks’ reassessment has been in turn challenged by Mermin and (...) Schack. Hereby I critically assess their reply, with the aim of bringing further clarification concerning the meaning, scope and relevance of von Neumann’s theorem. I show that despite Mermin and Schack’s response, Bub’s and Dieks’ reassessment is quite correct, and that this reading gets strongly reinforced when we carefully consider the connection between von Neumann’s proof and Gleason’s theorem. To what degree can language be acquired from linguistic input alone? This question has vexed scholars for millennia and is still a major focus of debate in the cognitive science of language. The complexity of human language has hampered progress because studies of language–especially those involving computational modeling–have only been able to deal with small fragments of our linguistic skills. We suggest that the most recent generation of Large Language Models (LLMs) might finally provide the computational tools to determine empirically (...) how much of the human language ability can be acquired from linguistic experience. LLMs are sophisticated deep learning architectures trained on vast amounts of natural language data, enabling them to perform an impressive range of linguistic tasks. We argue that, despite their clear semantic and pragmatic limitations, LLMs have already demonstrated that human-like grammatical language can be acquired without the need for a built-in grammar. Thus, while there is still much to learn about how humans acquire and use language, LLMs provide full-fledged computational models for cognitive scientists to empirically evaluate just how far statistical learning might take us in explaining the full complexity of human language. In 1991 Larry Laudan and Jarret Leplin proposed a solution for the problem of empirical equivalence and the empirical underdetermination that is often thought to result from it. In this paper we argue that, even though Laudan and Leplin’s reasoning is essentially correct, their solution should be accurately assessed in order to appreciate its nature and scope. Indeed, Laudan and Leplin’s analysis does not succeed in completely removing the problem or, as they put it, in refuting the thesis of underdetermination (...) as a consequence of empirical equivalence. Instead, what they show is merely that science possesses tools that may eventually lead out of an underdetermination impasse. We apply their argument to a real case of two empirically equivalent theories: Lorentz’s ether theory and Einstein’s special relativity. This example illustrates the validity of Laudan and Leplin’s reasoning, but also shows the importance of the reassessment we argue for. (shrink)

It is a widespread belief that the Kochen-Specker theorem imposes a contextuality constraint on the ontology of beables in quantum hidden variables theories. On the other hand, after Bell’s influential critique, the importance of von Neumann’s wrongly called ‘impossibility proof’ has been severely questioned. However, Max Jammer, Jeffrey Bub and Dennis Dieks have proposed insightful reassessments of von Neumann’s theorem: what it really shows is that hidden variables theories cannot represent their beables by means of Hermitian operators in Hilbert space. Hereby I show that i) the very same constraint can be derived from Gleason’s theorem, and that ii) if we consider the import of von Neumann’s and Gleason’s theorems, the relevance of the Kochen-Specker theorem for hidden variables theories gets substantially weakened: it does not force them to be contextual in any interesting sense of the term. In this paper I argue that the case of Einstein׳s special relativity vs. Hendrik Lorentz׳s ether theory can be decided in terms of empirical evidence, in spite of the predictive equivalence between the theories. In the historical and philosophical literature this case has been typically addressed focusing on non-empirical features. I claim that non-empirical features are not enough to provide a fully objective and uniquely determined choice in instances of empirical equivalence. However, I argue that if we consider arguments proposed (...) by Richard Boyd, and by Larry Laudan and Jarret Leplin, a choice based on non-entailed empirical evidence favoring Einstein׳s theory can be made. Greco wants to understand the difference between knowledge generation and transmission. Doing so, he argues, will show that there are substantively different norms governing the two types of knowledge acquisition. I offer an alternative way of cashing out the difference between transmission and generation in non-normative terms.

Pérez Carballo adopts an epistemic utility theory picture of epistemic norms where epistemic utility functions measure the value of degrees of belief, and rationality consists in maximizing expected epistemic utility. Within this framework he seeks to show that we can make sense of the intuitive idea that some true beliefs—say true beliefs about botany—are more valuable than other true beliefs—say true beliefs about the precise number of plants in North Dakota. To do so, however, Pérez Carballo argues that (...) we must think of the value of epistemic states as consisting in more than simply accuracy. This sheds light on which questions it is most epistemically valuable to pursue. (shrink)

On a view implicitly endorsed by many, a concept is epistemically better than another if and because it does a better job at ‘carving at the joints', or if the property corresponding to it is ‘more natural' than the one corresponding to another. This chapter offers an argument against this seemingly plausible thought, starting from three key observations about the way we use and evaluate concepts from en epistemic perspective: that we look for concepts that play a role in explanations (...) of things that cry out for explanation; that we evaluate not only ‘empirical' concepts, but also mathematical and perhaps moral concepts from an epistemic perspective; and that there is much more complexity to the concept/property relation than the natural thought seems to presuppose. These observations, it is argued, rule out giving a theory of conceptual evaluation that is a corollary of a metaphysical ranking of the relevant properties. -/- conceptual ethics, explanation, naturalness, epistemic value, concept/property, semantic internalism. Many think that expressivists have a special problem with negation. I disagree. For if there is a problem with negation, I argue, it is a problem shared by those who accept some plausible claims about the nature of intentionality. Whether there is any special problem for expressivists turns, I will argue, on whether facts about what truth-conditions beliefs have can explain facts about basic inferential relations among those beliefs. And I will suggest that the answer to this last question is, (...) on most plausible attempts at solving the problem of intentionality, ‘no’. (shrink)
